Drake Says He Won’t Engage in Beef With Common Anymore

"Despite how it's been worded by him that situation is not a 'hip-hop moment' or a 'battle for the sake of musical integrity'... it's a ploy for attention around the release of an album," Drizzy said about his decision to stop the beef...

Paula Abdul Speaks Out About 'X Factor' Exit

Abdul confirms news in statement and says 'business decisions often times override personal considerations.'

We've only had a few hours to digest the three very surprising exits from "X Factor" that were announced Monday, and we're still scratching our heads at what happened over at Fox to make such drastic changes to the singing competition.

For many fans, the biggest shock was Simon Cowell and company's letting go of original "American Idol" diva and delightfully unpredictable judge Paula Abdul, who has since released a statement about her departure. "Yes, it's true; I won't be returning to The X Factor next season," Abdul said in a statement. "I've learned through my longevity in this industry that business decisions often times override personal considerations. Simon and I, along with Fox and Fremantle, have been communicating about this for a while now, and I have absolute understanding of the situation. Simon is, and will remain a dear friend of mine and I've treasured my experience working this past season with my extended family at Fox and Fremantle. I want nothing more than for The X Factor to exceed ALL of their wildest dreams. This truly has been a blessing and I am most grateful."

Although they have not released official statements as of yet, we expect to hear from the other two ousted "X Factor" folks, Nicole Scherzinger and host Steve Jones, sometime soon.

The former Pussycat Doll and "Dancing With the Stars" champ will reportedly turn her attention back to her music career, while Abdul and Jones will be looking for their next big things.

As far as we know, L.A. Reid will continue to work alongside Cowell on the judging panel. There has been no word yet from Fox on who might replace Abdul, Scherzinger and Jones, or when season two will premiere.

What do you think Paula Abdul should do after "X Factor"? Leave your comment below.

Dimmu Borgir Release Live DVD; Plus Led Zeppelin, Brujeria, & More News That Rules, In Metal File

'It shows the intense live side of the band, as opposed to the perfection and the cleanness of how we sound on our albums,' guitarist says.
By Chris Harris

On October 14, Dimmu BorgirDimmu Borgir — who just happen to be Demi Lovato's favorite black-metal band — will release a a three-disc DVD/CD set called "The Invaluable Darkness," the band's first visual offering since 2002's "World Misanthropy." Boasting live footage shot last year, during gigs in Norway, Germany and England, "The Invaluable Darkness" demonstrates the unbridled furor of seeing Dimmu live, guitarist Silenoz said. "It shows the honest rawness and atmospheric darkness of our concerts," the Norwegian told Metal File last week, after dismissing recent online rumors that his band's next LP would be coming out through Roadrunner Records. "Basically, it shows the intense live side of the band, as opposed to the perfection and the cleanness of how we sound on our albums. It's just a different side to the band, basically." Dimmu Borgir began thinking about "The Invaluable Darkness" two years ago, but didn't start capturing footage until last summer, Silenoz explained, adding that the band will use its current stint on the Blackest of the Black Tour — which got underway Thursday night in Miami Beach, Florida, and also features the tour's founder, Danzig, along with MoonspellMoonspell, Winds of PlagueWinds of Plague and Skeletonwitch — to promote the DVD. Dimmu Borgir will not, however, use the tour to write material for their next LP. "It's our first time on Blackest, but Glenn [Danzig] had wanted to bring us out before [on the tour], but we weren't available until now," Silenoz said. "We've done Ozzfest before, but we're looking forward to this tour more. We did the main stage on Ozzfest, playing in f--_ing broad daylight. This tour will let us play in bigger places, but at the same time showcase more of what the band's about, visually. We are going to concentrate on the tour for now. Some years ago, we tried putting [material] together on the road, but once we got home, we listened back to it, and were like, 'What the f--- is this?' So, we just scrapped it all. We find it's so much better to totally focus on one thing at a time, and then, when that's over, you move on to the next [thing]. We don't really feel like we need to rush things, anyway, so we'll just take our time, and it's going to be what it's going to be." Dimmu Borgir hope to reconvene in late December to begin writing the follow-up to 2007's diabolically titled In Sorte Diaboli. "We have some ideas floating around already, but we haven't arranged any material yet," he said. "We'll start doing that once the touring for this DVD is over." The band's frontman, Shagrath, is also due to marry soon — he's engaged to actor Nicolas Cage's ex-girlfriend, Christina Fulton, so that may have an effect on when Dimmu finish their next album, which Silenoz said could be out this coming spring. "I'm sure [Shagrath] won't let anything get in the way [of] the band — I think, I hope," the guitarist said. "We don't need a Yoko [Ono] situation." While Dimmu have been at it going on 15 years now, Silenoz said he doesn't think their forthcoming material will be much of a departure from their previous black-metal offerings. "And we have always been about more than just that term, 'black metal,' " he said. "Luckily for us, the older you get, the less concerned you get with the categorization and putting labels on your music. Things start getting more and more limitless with us, and we know that we operate within certain frames. But we try not to analyze things too much, because it's just going to be working against you in the end. When we write new stuff, we don't think about what we should write — we just get together, and put material together, and if we like it, we keep it. That's the formula, if we even have a formula." Dimmu Borgir are definitely getting older — guitarist Galder will be missing Blackest because of a recent addition to his family, and Susperia'sSusperia's Cyrus will be filling in for him; while former VaderVader drummer Dariusz Brzozowski takes over for Hellhammer, who had to leave the band in 2007 after sustaining a neck injury that's now limited the use of his right arm. As Dimmu has gotten on in years, Silenoz admits they have failed to keep pace with some of the more extreme black-metal acts that have followed in their wake. "We helped open doors for the more extreme bands out there," Silenoz said. "I'm sure we helped open doors for bands like Watain, [insomuch as] people that had maybe started listening to us first then went on to the more extreme stuff. Let's face it — we're not as extreme as Watain and other bands like that, but we're fine with that." The Blackest of the Black Tour continues through November 10 in San Francisco. The rest of the week's metal news: Dimmu's tourmates on Blackest, Winds of Plague, have announced ex-Azusa drummer Art Cruz has joined their ranks — he replaced Jeff Tenney. According to the band's blog, "Art has already added a new spark to the band and has provided us with a solid backbone that will allow us to continue our rampage stronger than ever." ... What the world really needs is another Led ZeppelinLed Zeppelin box set, so, on November 4, Rhino Records will issue the Led Zeppelin Definitive Collection Mini LP Replica CD box set. For just $200, you'll get 1969's Led Zeppelin, 1969's Led Zeppelin II, 1970's Led Zeppelin III, 1971's Led Zeppelin IV, 1973's Houses of the Holy, 1975's Physical Graffiti, 1976's Presence, 1976's The Song Remains the Same, 1979's In Through the Out Door and 1982's Coda, as mini-LP replicas, with artwork from the original U.K. LP sleeves. Now, you know what you can get your dad for Christmas. ... Former Killswitch EngageKillswitch Engage frontman Jesse Leach and current Killswitch Engage guitarist Adam Dutkiewicz have teamed up for a new project they're calling Times of Grace, and they've already started working on material for their debut album. According to Leach, "We have two songs to go and we will be finished with all of the vocals. Adam has taken lead vocals in three songs as of yet and he is doing a great job. We also worked on a track yesterday that is so epic — we trade vocals and do two different melodies at the same time. This album went from a melodic metal album to an epic mix of metal/rock/pop/shoegaze and punk. So all of your metal expectations will be incorrect — we are pushing genre boundaries." To quote "Meet the Parents," we'll look forward to that, Greg. ... The Funeral Pyre and Early Graves will be hitting the road together next month, starting November 7 in South Lake Tahoe, California. Dates are booked through November 21 in Hollywood. ... The latest incarnation of Brujeria, which features CarcassCarcass frontman Jeff Walker and Napalm Death'sNapalm Carcass's Shane Embury, have lined up several U.S. dates for this winter. The band will begin its brief trek November 28 in Denver, and wrap things up in Dallas on December 7. ... DemiricousDemiricous will be touring with the Gates of Slumber starting November 9 in Denver, for a jaunt that's scheduled to run through December 6 in Indianapolis. ... Mary J. Blige Dishes On Her 'Crazy' Led Zeppelin Covers

'I've listened to their music since I was a child,' says the R&B diva, who recorded 'Stairway to Heaven' and 'Whole Lotta Love.'
By James Montgomery, with reporting by Larry Carroll

Photo: MTV News

You wouldn't peg Mary J Blige as the black-light-and-tapestry sort, but, as has become readily apparent in recent weeks, she absolutely loves Led Zeppelin. In early February, reports began circulating that Blige had re-recorded Zeppelin's classic "Stairway to Heaven," working with Travis Barker, "American Idol" judge Randy Jackson and guitarist Steve Vai on the track, which is slated to appear on the international reissue of her Stronger With Each Tear album, due Monday.

But after she had recorded "Stairway," Blige continued to get the Led out, covering another Zeppelin classic — the thunderous "Whole Lotta Love" — for the album too. And when MTV News caught up with her on the Essence Black Women in Hollywood red carpet, she told us all about channeling her inner Robert Plant for the tracks, a process that came much easier than you'd probably imagine. "I did Led Zeppelin's 'Stairway to Heaven' and 'Whole Lotta Love' — it's crazy," she said. "I am a Led Zeppelin fan. I'm not going to say I've been to their concerts, but I've listened to their music since I was a child, and it's always moved me, especially 'Stairway to Heaven,' and 'Whole Lotta Love' is just fun." Blige also said she recorded another new song — a "club record" called "I Can't Wait" — for the re-release. And while it's only slated to hit shelves outside the U.S., she hopes her fans will get a chance to hear all the new songs pretty soon. "I want y'all to hear it," she laughed.

Our Favorite Celebrity Couples Of 2011

From Britney and Jason to K-Stew and R-Pattz, we look back at the best high-profile pair-ups of the year.

From young love to established romantic empires, 2011 was all about PDA. Some of La La Land's most A-list couples weren't shy about flaunting the love they share. From musicians to actors to everyone in between, the last 12 months were all about sharing the love. As the year winds down, MTV News is reflecting on some of our favorite couples of the year.

Britney Spears and Jason Trawick
The couple walked red carpets, gave each other shout-outs at awards shows and even got naked together in Britney's "Criminal" video, but it wasn't until December that they decided to make it official. After two years of dating, Spears and Trawick took their relationship to the next level, with confirmation that Jason put a ring on it. The pair celebrated their love and their impending nuptials in Las Vegas. Their engagement sparked headlines and left Spears "glowing." Who is your top couple of 2011? And when they weren't chilling out, they were giving shine to each other's hard work. Or bringing each other gifts. Remember when Bieber showed Selena his pet snake, Johnson, at the VMAs? Katy Perry Debuts Light-Blue Locks In Vegas

Pop star shows off new 'do at a Las Vegas charity event.

Katy Perry is feeling a little less blue these days. The pop star began rocking an electric-blue bob not long after news broke that husband Russell Brand had filed for divorce late last year. But Perry, who stepped out in Las Vegas this weekend, appears to have dipped her locks in the dye once again.

On Friday night, KP hit a charity event dressed in a beaded frock, her razor-cut 'do colored in a rich turquoise. The party at the Vegas outpost of nightspot 1OAK was hosted by GiveLove.org, an organization devoted to improving public health in Haiti.

But although newly separated Perry reportedly put on a good face, one source told amNewYork the "Waking Up in Vegas" singer seemed "subdued." The pop star "pretty much sat in the same spot the whole night" as her friends danced, according to the source.

While Katy has always been adventurous about her hair hues, post-split, she seems, anecdotally at least, to be hitting the bottle — of dye — with increasing frequency.

Brand and Perry announced the end of their marriage on December 30, after 14 months together. The exes have been a keeping a rather low profile ever since. The comic is set to perform on March 4 at New York's Radio City Music Hall as part of an Amnesty International benefit, while Perry may turn up next at the Grammy awards on February 12, where she's up for two statues. She was spotted earlier this month shooting an Adidas ad, not long after wrapping two concert dates in Indonesia and the Philippines.

Lady Gaga's Big 2012: A Psychic Weighs In

'This tour is going to be really good for her,' psychic Jesse Bravo says of Gaga's planned 2012 BTW Ball.
By MTV News Staff

As 2012 rolls along, Lady Gaga has already teased she has some big plans ahead. So MTV News decided to look to New York-based psychic Jesse Bravo to see what fate has in store for the pop superstar. Bravo recently rolled up to the MTV News offices and looked into his crystal ball.

"Lady Gaga for 2012, it's going to be sort of a slower year for her because she has her tour, which means she's not putting out a lot of new material," Bravo explained, despite Gaga's tease that she is working on her follow-up to 2011's Born This Way. "So for me, when I sort of looked up around there to see what was happening for her, I saw her sales sort of slow down because of new material. But she's also building up this new momentum for running her base for this tour. This tour is going to be really good for her." Gaga has already thought about the Born This Way Ball, tweeting over the holidays that she was pondering the things she wants to sell on tour. "Designing merch for the tour, when you see it you will die. #deathbyinexpensiveglamour," she wrote. Mother Monster is also famously known for her wild style, which Bravo said won't disappoint in the next 12 months. "I believe her next big outfit is a cross between two things, and I was sort of stuck in between, like, where I should go with this because I saw two outfits, which means they can come in succession," he said. "I don't know which one is going to come first. But I will believe the one that I saw is this outfit, and I can't really describe it, but it's going to have lights embedded in it. So it's going to be pretty bizarre. And then I saw another outfit and it's like a body outfit, one that you spray-paint on, and I don't know if it's a stars-and-stripes theme, but I saw that there were stars and stripes in the right areas." In addition to all the ups in her career, Gaga's personal life will also prosper, according to Bravo, which means that she may get even more serious with her rumored beau and "You and I" co-star, "Vampire Diaries" actor Taylor Kinney.

"Her personal life is going to stay stable for a while. The reason why is that on the outside she shows she's a strong character — and for business she is — but on the inside she's a mush. And so as a result, she needs to have her relationship in place, especially right now when she needs that support on going on something that's so big," he said. "Two years is a long, long time [to tour]. I don't think that relationship is going ... it's not going out." Just how serious might they get? Well, Gaga, believe it or not, is already pondering a family, according to Bravo. (Although she did note in a recent interview that the only family she is focused on is her new music.) "I also feel this need of having children. So I don't know how this is going to play because we know she has a tour and she's not going to stop the tour short to have a child," Bravo predicted. "And I know that work is on her mind, but I know that [her spirit guide] Liberace is telling me about a child. And I know that in the back of her mind, she wants one. I think with her, it's about scheduling ... and I would say we're looking somewhere at 2014-2015. That's going to be her time." What do you think about Jesse Bravo's predictions for Lady Gaga? Tell us in the comments!

Do Foo Fighters Know Robert Pattinson From Robert Plant?

During band's rehearsal break for Sunday's Movie Awards, we put Foos to the test.

UNIVERSAL CITY, California — Hard rock, heavy metal, hardcore and punk have long gone hand-in-hand with evil wizards, magic, vampires and werewolves. And with a collective sub-cultural pedigree that includes stints in the Germs, No Use for a Name, Sunny Day Real Estate, Scream and some band called Nirvana, you'd think the Foo Fighters — set to perform at Sunday's Movie Awards — would know their "Potter" from their Zeppelin. Certainly they can recognize a "wand" reference and pinpoint its origin?

Right? Before we put MTV News' magically crafted trivia to the band, it seemed safe to assume the Foos would accurately distinguish between the words of Harry Potter, a "Twilight" character and Led Zeppelin. But was their underground nerd cred blown to shreds? Read on — and click the video! — to see how the Foo Fighters fared when we caught up with them on the Universal Studios lot, shortly after they finished rehearsing their Movie Awards performance. Our own Jim Cantiello played dungeon master as Dave Grohl, Nate Mendel, Taylor Hawkins, Chris Shiflett and Pat Smear were given a series of semi-famous lines and asked whether they originated with "Harry Potter," the "Twilight Saga" or the lyrics of hard-rock pioneers Led Zeppelin. Here's a sampling of a few of those one-liners: » "The elder wand, the most powerful wand ever made." » "Why don't you let me be yours ever truly? Can I make your garden grow?" » "You're lying, Dolores! You mustn't tell lies!" Can you guess whether the lines above came from the "Potter" flicks, "Twilight" or Robert Plant? Watch as the Foos try their best to do exactly that. Then tune in to the MTV Movie Awards on Sunday to catch the Foo Fighters rock the stage with their new single, "Walk." Will wizards, vampires or dream thieves steal the 2011 MTV Movie Awards? Find out June 5, when the 20th annual show airs live at 9 p.m. ET/PT. Tune in at 7:30 p.m. ET/PT that night for the "America's Best Dance Crew" finale and Movie Awards pre-show, loaded with live action from the red carpet, exclusive movie clips and a special edition of "After Hours."

Russell Brand To Star In Michael Bay's 'Hauntrepreneur'

Brand will also perform at Amnesty International's Secret Policeman's Ball, along with Coldplay, Jon Stewart and Stephen Colbert.

Russell Brand has nabbed a starring role in the Michael Bay-produced "The Hauntrepreneur."

The movie will revolve around a "peculiar man" (presumably Brand, given his penchant for those types of roles) who is hired by a family to help them adjust to living in a new town. Calling himself the "Hauntrepreneur," he creates a haunted house full of kooky characters to try to help them get acclimated to their new surroundings, Variety reports.

Paramount has yet to comment on the casting. It marks the latest move Brand has made since filing for divorce from Katy Perry over New Year's weekend.

On Wednesday, it was announced that Brand will perform as part of an Amnesty International benefit March 4 at New York's Radio City Music Hall. It marks his first public appearance since news broke of his split from Perry. Coldplay, Mumford & Sons, Jon Stewart, Stephen Colbert, Reggie Watts and others will also appear at Amnesty International's Secret Policeman's Ball.

Brand will next be seen in "Rock of Ages," alongside Tom Cruise, Julianne Hough, Mary J. Blige and Alec Baldwin. The big-screen adaptation of Broadway's rock musical will open June 1. He's also attached to Diablo Cody's "Untitled Diablo Cody Project," which also will feature Hough.

Additionally, he's working with the FX network on a series of six half-hour late-night comedy specials that will be filmed in front of a live audience as well as an animated comedy he co-created that will air on the Fox network.

Conrad Murray Sentenced To Four Years In Jail

Former Michael Jackson doctor faces another hearing in January to potentially provide more than $101 million in restitution to the Jackson family.
By Gil Kaufman

Dr. Conrad Murray listens as he sits in court during his sentencing for the involuntary manslaughter of singer Michael Jackson at the Los Angeles Superior Court on November 29, 2011 in Los Angeles, California. Judge Michael E. Pastor sentenced Murray to four years in county jail for his involuntary manslaughter conviction of Jackson.

Former Michael Jackson doctor Conrad Murray was back in a Los Angeles courtroom on Tuesday morning (November 29), where he was ordered to serve the maximum of four years in county jail. The cardiologist, who was found guilty of one felony count of involuntary manslaughter November 7, was facing up to four years in state prison in the death of the pop icon, but due to recent changes to alleviate overcrowding in California prisons, the judge in the case said he was was unable to send the doctor to state prison for his crime.

Los Angeles Superior Court Judge Michael Pastor had leeway in the sentencing, with options ranging from probation to the full sentence, but in a lengthy ruling from the bench he said that Murray's lack of remorse and negligent behavior argued for the highest possible penalty. Do you think Conrad Murray deserved the maximum sentence? Let us know on Facebook. "He is and remains dangerous ... the request of probation is denied, the court imposes the high term of four years imprisonment in this case," Pastor said during the 90-plus minute hearing. Murray will serve his time in the Los Angeles County Jail, as well as pay nearly $900 in court fees and face another hearing in late January 2012 on a request by the prosecution to provide more than $101 million in restitution to the Jackson family. Murray was found guilty by a jury of one felony count of involuntary manslaughter after prosecutors convinced them that Murray's reckless use of the surgical anesthetic propofol led to the singer's death. Before Pastor's ruling, prosecutors not only asked for the maximum sentence, but also that Murray pay Jackson's children more than $100 million in restitution, which is the amount they believe the singer would have earned had he lived to perform his "This is It" comeback tour, in addition to nearly $2 million in funeral expenses. Prior to handing down the sentence, a peeved-looking Pastor answered a defense question regarding a last minute notice from the prosecution noting that two previous cases suggest that involuntary manslaughter could be considered a "serious" offense and thus should subject Murray to federal prison time. "I don't think these cases have any impact on the realignment statute," Pastor ruled, referring to the new rules regarding sentencing that he believed superseded the earlier cases. Attorney and friend Brian Panish read a statement from the Jackson family at the beginning of the proceedings. "There is now way to adequately describe the loss of our beloved father, son, brother and friend," Panish said. "We still look at each other in disbelief, is it really possible that he is gone? As Michael's parents we never could have imaged we would live to witness his passing. It is simply against the natural order of things. As his brothers and sisters we will never be able to hold, laugh, or perform again with our brother Michael. And as his children, we will grow up without a father, our best friend, our playmate and our dad. We are not here to seek revenge, there is nothing you can do today that will bring Michael back. But we will keep the love in our in our hearts that Michael embodied throughout his life. His passion was for unifying the world through the gift of his artistry. We respectfully request that you impose a sentence that reminds physicians that they cannot sell their services to the highest bidder and cast aside their Hippocratic oath to do no harm. As we all know from this tragedy, doing so can have devastating results. The bible reminds us that men cannot do justice they can only seek justice. And that is all we ask as a family and that is all that we can ask for here." As in the past, Murray, 58, sat stone-faced, listening to the statement and prosecutor David Walgren's quick rehashing of the facts in the case. "He looked out for himself and not Michael Jackson," Walgren said, going on to argue why the court should deny the defense's request for probation. He quoted Pastor's own comments about the dangerous nature of Murray's action following the verdict as evidence that Murray should face a more serious penalty than probation. He said Murray's abandonment of a vulnerable Jackson in the time of the singer's need, as well as the planning the doctor underwent to procure the propofol and to not keep clear medical records about their administration were also reasons to deny probation. "It is the people's position that prison is warranted," Walgren said, adding that it was Murray's negligent actions before, during and after Jackson's death, as well as his lack of remorse and failure to take personal responsibility — as evidenced in clip from a documentary interview nine days before the verdict in which he denied culpability — that call for the longer term. A number of Jackson's family members, including mother Katherine and siblings LaToya, Jermaine, Randy and Rebbie, were reportedly on hand for the court date. When asked by the judge if the new sentencing laws allowed Murray to be sent to prison for the full term, Walgren said they did not. While the defense did not call any witnesses to testify — and Murray did not wish to speak — defense attorney Ed Chernoff did reference more than 30 pages of support memorandum from friends, family and patients in his brief statements. He agreed that Murray's actions do warrant punishment, but asked how the court viewed the book of Murray's life, versus one chapter. "He shouldn't have done it," he said of Murray's actions. "We're going to be honest about vulnerability. Michael Jackson was a drug seeker and he sought it out from Dr. Murray who was wrong in providing it." Chernoff painted Jackson as a rich, powerful person who had the means to do whatever he wanted and asked the court to consider Murray's life before the doctor began working for Jackson. He described Murray's currently cloistered existence in jail in protective custody and asked, "but what about the rest of his life? What about before Michael Jackson asked for propofol?" he wondered, noting that for 56 years Murray had never run afoul of the law and had raised a family following his destitute beginnings on the island of Grenada. "Does any of that matter at all?" Chernoff asked dramatically as he unspooled his client's rise from poverty and what he described as a professional life dedicated to helping poor and disadvantaged patients. "I think it should matter," he answered. "But when the glow of vengeance has faded, he still is someone else's problem. And Dr. Murray can do things for the community on probation that he could never do sitting in that room." Pastor noted that he had discretion in sentencing in this case and that he took into account that both sides have said that Murray's actions did result in the death of Jackson, though pointedly noted that Murray did not take responsibility in the MSNBC documentary that aired days after the guilty verdict. Because the case involved criminal negligence, which requires more than carelessness or mistake in judgment, but reckless actions that result in death, Pastor said it was important to focus on those factors. "This is not a question about what might have happened or what if someone else had been involved if not for Dr. Murray," he said. "That is an insult to the medical profession. The fact is that Michael Jackson died because of the action of and the failure to perform the medical duties of Dr. Murray." The judge said he had taken into account the full story of Murray's life, but said the "unconscionable lies" to medical personnel and a series of "inconceivable" decisions the doctor made on June 25, 2009 jeopardized the life of his patient and superseded what the doctor had done before. "Why give probation to someone who is offended by the whole idea that that person is even before the court," he said, referring to a "failure of character" on behalf of Murray, most specifically, a secret recording the physician made of the singer that Pastor characterized as a type of "insurance policy" against a potential future conflict between the doctor and patient that seemed beyond the pale. The day before the sentence was handed down, Murray's mother, Milta Rush, reportedly wrote a letter to judge Pastor asking him for mercy, saying, "his [Murray's] compassion and his soft heartedness for others led to this dilemma." Pastor said he could find no reason to grant probation to Murray, whose actions he called a "gross, continuing deviation" from medical standards, and who he claimed is and remains a danger to the community. Without the legal authority to send Murray to state prison, Pastor said, "the court has determined that the appropriate term is the higher term of four years imprisonment ... because I find that Dr. Murray had abandoned his patient, who was trusting him ... he has absolutely no remorse." A future date in January was set to begin discussing the prosecution's request for restitution. After being given credit for 46 days of time served and good time credit, Murray was led out of the courtroom in handcuffs. The Los Angeles County Sheriff will determine how much time Murray will actually do in his equally overcrowded jail and Murray's lawyers have indicated that they plan to launch an appeal at a later date.
